C.C. v. F.C., et al. Date: July, 2018 Practice Area:Construction Litigation Description: AMedical Business hired a company to remodel and build additional exam rooms for business expansion. Improper planning and installation resulted in a flood damaging the business’s building structure, leaving mold and rendering the building unfit to conduct business. Further, the Medical Business signed an ill-advised release so that the company would complete the construction quickly allowing them to resume business. Result: Medical Business hired Parton & Associates who, without filing a complaint, forced the company and its subcontractor to pay for all building damage, including all material costs, pro-active mold removal, and lost profits for days the Medical Business was forced to be closed.
J.C. v. O.B., et al. Date: July, 2018 Practice Area: Commercial Litigation Description: Client invested in a business with the agreement that Client was to be paid back principal investment plus return on investment. The Defendant never made single payment was non-responsive to communication from Client prior to retaining Parton & Associates. Result: Parton & Associates filed suit and Client received a six-figure judgment and award of attorneys as a result of the opposing parties failure to comply.
State v. M.L. Date: May, 2018 Practice Area: Criminal Defense Description: Client charged with Death by Motor Vehicle. Result: Client plead guilty to one count of Reckless Driving.
State v. M.B. Date: April, 2018 Practice Area: Criminal Defense Description: Client facing mandatory life sentence without parole after being charged with 1st Degree Murder & 1st Degree Arson in case garnering intense national and local media coverage. Result: After Parton & Associates filed motions challenging the State’s use and testing of DNA and implemented a cutting edge restorative justice based victim outreach strategy, the State accepted a plea of 2nd Degree Murder, 1st Degree Arson, and Malicious Damage to Property.
State v. A.K. Date: April, 2018 Practice Area: Criminal Defense Description: At the time of retaining Parton & Associates, Client had 11 criminal charges including Assault on a Government Official. Result: Client received a prayer for judgment which resulted in only court costs and fines. All other charges dismissed. State v. I.G. Date: March, 2018 Practice Area: Criminal Defense Description: Client charged with DWI and held without bond prohibiting him from voluntarily returning to his home country. Result: Charges were voluntarily dismissed by the State after Parton & Associates made motions related to the State’s attempts to delay prosecution.
D.D. v. U.P. Date:August, 2017 Practice Area: Construction Litigation Description: General Contractor failed to pay Subcontractor Client for thousands of hours of labor and materials performed in relation to one of Uptown Charlotte’s large high-rise construction projects. Result: Parton & Associates placed a lien on funds from work associated with the project, forcing General Contractor to agree to confidential settlement payment to make Client whole.
State v. B.W. Date: July, 2017 Practice Area: Criminal Defense Description: Client was charged with Discharging a Firearm in City Limits, Carrying a Concealed Weapon, and Possession of Marijuana stemming from an incident which the State described as a series of drive-by shootings. Result: After Parton & Associates negotiated with the State, Client plead guilty to Possession of Under 1/2 Oz. of Marijuana and was sentenced to one day in jail with credit for prior time served.
C. Inc. v. W.K. Date: March, 2017 Practice Area: Commercial Litigation Description: Corporate Client was unable to conduct regular business due to threats from larger competitor related to non-competition agreement. Result: Parton & Associates asserted that the agreement was unenforceable and initiated eventual settlement that voided competitor's agreement without any payment or future contractual obligations by Client. B.P. v. C.R. Date: March, 2017 Practice Area: Commercial Litigation Description: Client was an angel-investor in a startup corporation that had recently informed all investors they would not be receiving any return, despite the fact that the corporation was about to be acquired by another corporate entity for a large cash payment. At the time of retaining Parton & Associates every other investor had acquiesced and settled their matter, signing a release of right to any claim. Result: After threatening to tie up the corporation's acquisition through a little known NC foreign corporation asset freeze statute, the corporation settled and client received 25 times the funds that other investors did.
State v. T.S. Date: February, 2017 Practice Area: Criminal Defense Description: At the time of retaining Parton & Associates, Client was in custody with a six-figure bond and three pending charges of Felony Robbery with a Dangerous Weapon. Evidence included a videotaped confession and independent corroboration of surveillance video. Result: Client's bond was reduced by approximately two-thirds pursuant to Parton & Associates motion. Client later plead to two counts of Common Law Robbery and one count of Attempted Common Law Robbery and was placed on probation with credit for time served.
Corporate Plaintiff v. B.P. Date: February, 2017 Practice Area: Commercial Litigation Description: Client came to Firm with three pending lawsuits by a Corporate Plaintiff alleging the fraudulent transfer of assets seeking over 1 million dollars in damages and the seizure of Client's current business holdings. Result: After Parton & Associates filed Motions to Dismiss based on improper jurisdiction and technical readings of the Fraudulent Transfer Statute, Corporate Plaintiff Voluntarily Dismissed all three pending cases the day before the Motions were to be heard in court and received nothing from our Client.
State v. T.F. Date: May, 2016 Practice Area: Criminal Defense Description: Client charged with Felony Fleeing to Elude an Officer, Reckless Driving, Speeding in excess of 100 mph, and multiple other moving and registration violations in two counties resulting from a lengthy, high-speed police chase. Result: All charges dismissed.
State v. T.B Date: August, 2015 Practice Area: Criminal Defense Description: Client charged with Firearm Possession by Felon while on probation for prior felony conviction and facing a 30 month active prison sentence in addition to possibility of probation violation. Client had been offered plea deal of 13 months active time while represented by previous counsel before retaining Parton & Associates, PLLC. Result: Plea deal involving 90 days active sentence and client able to remain on probation.
State v. S.P. Date: July, 2015 Practice Area: Criminal Defense Description: Client charged with Discharge of a Firearm in City Limits during incident that resulted in death of a bystander and critical injury of another. Result: Plead to Injury to Personal Property and sentenced to 12 months probation.
State v. M.W. Date: December, 2015 Practice Area: Criminal Defense Description: Client with multiple prior DWI convictions charged with DWI and Driving While License Revoked for incident involving an accident with another vehicle and pedestrian. Result: All charges dismissed.
State v. A.B. Date: March, 2016 Practice Area: Criminal Defense Description: Client charged with Possession of Controlled Substance and Driving While License Revoked based on testimony from confidential informant. Result: All charges dismissed after Parton & Associates filed a Motion to Suppress evidence obtained as a result of confidential informant's testimony.
D.S. v. Local Police Dep't Date: June, 2015 Practice Area: Police Misconduct Description: Complaint brought before Citizens' Review Board for allegations of Officer's violation of Arrest, Search and Seizure policy resulting from search of Client's home. Result: Board recommendations to Chief of Police and City Manager that officers equipped with body cameras use them during all interactions with citizens, and that a policy be established mandating the time within which follow up investigations must be conducted.
H.G. v. B.N. Date: February, 2016 Practice Area: Civil Litigation Description: Corporate Plaintiff filed suit against Client for alleged violation of non-compete agreement seeking six-figure damages. Result: Client settled for approximately 3% of what Corporate Plaintiff was seeking, and was released from former non-compete agreement.
In re P.A.C. Date: July, 2013 Practice Area: Civil Litigation Description: Corporate Client had previously received unfavorable decision from an Appeals Referee requiring them to make recurring unemployment payments to former employee who had been terminated for misconduct. Result: Decision of Appeals Referee was completely overturned after Parton & Associates written appeal to the Employment Security Commission.
Sorokin v. Winfield Date: May, 2014 Practice Area: Civil Litigation Description: Client, a foreign musician and rock-n-roll enthusiast, was defrauded into purchasing a valuable, iconic Eric Clapton guitar from a local dealer who never actually possessed the guitar. Result: Judgment of $35,272.00 entered in Client's favor while Defendant, who was found to be defrauding many other musicians and collectors, was forced to declare bankruptcy.
State v. L.S. Date: October, 2015 Practice Area: Criminal Defense Description: Client charged with Possession of Controlled Substance, Possession of Marijuana, Possession of Drug Paraphernalia, and Carrying a Concealed Weapon. Result: All charges dismissed after Parton & Associates PLLC filed a Motion to Suppress based on the State's violation of North Carolina's Racial Data Collection Statute.
